2008 D-Tools Design Awards Program Entry Release Agreement I grant D-Tools, Inc. the right to use any of the content submitted with my entry in the 2008 D-Tools Design Awards. Use will be limited to promotional purposes, editorial coverage, demonstration purposes, for event promotion, and for display at the events in which D-Tools, Inc. participates. By submitting this entry form and by selecting “I Accept” to submit my entry, I declare that I or the company with which I am associated have the authority to bind, own all rights, title, and interest in such portions of the entry form that are subject to copyright or similar protection under applicable United States and foreign laws. I also verify that any confidential or personal client information has been modified or deleted or that I have my client’s express written consent to submit such information. Where any rights have been vested in another entity, I have obtained written permission from such entity to submit these materials to D-Tools, Inc. for its use in connection with the 2008 D-Tools Design Awards. Disclaimer In no event shall the 2008 D-Tools Design Awards or D-Tools, Inc. be liable for any indirect, incidental, or consequential damages arising out of or in any way related with my (its) Entry Form, the 2008 D-Tools Design Awards, and any awards given. Indemnification By submitting my (its) entry, I or the company with which I am associated have the authority to bind, do hereby release and hold harmless D-Tools, Inc., their affiliates, officers, and employees, from and against any and all losses, damages, or expenses of any nature (including reasonable attorney fees) that may arise from my (its) participation or acceptance of an award in the 2008 D-Tools Design Awards. Such indemnification shall include, but is not limited to, any claims based upon an alleged infringement of copyright or other proprietary rights WITHOUT LIMITING ANY PROVISION OF THIS AGREEMENT, I HEREBY ACKNOWLEDGE BY SELECTING “I ACCEPT,” I AKNOWLEDGE THAT UPON SUBMISSION, THIS AGREEMENT WILL BECOME A LEGALLY VALID AND ENFORCEABLE AGREEMENT. BY SELECTING “I ACCEPT” AND SUBMITTING A PROJECT, I: 1. Warrant that all information provided in this Release Form and any other content that is submitted for entry into the 2008 D-Tools Design Awards is accurate, and that I am an officer, employee, or agent duly authorized to act for the company submitting an entry; Consent, on behalf of the company to this Release Form acknowledges: (a) that I have reviewed the Awards Contest Details and Rules; (b) that acceptance is evidence of the company’s intent to sign this Release Form, to provide a symbol of its signature, and to be legally bound by this Agreement.
